AN ORDINANCE EXEMPTING THE CITY OF HAVEN, KANSAS FROM THE PROVISIONS OF K.S.A. 12-4112 AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT RELATING TO THE ASSESSMENT OF COURT COSTS IN THE HAVEN MUNICIPAL COURT.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF HAVEN, KANSAS:
SECTION ONE: The City of Haven, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it the provisions of K.S.A. 12-4112 and provide substitute and additional provisions as hereinafter set forth in this ordinance. Such referenced provisions are either enactments of a part thereof which are applicable to this City but are not applicable uniformly to all cities.
SECTION TWO: There
shall be assessed as court costs in all cases filed in the Municipal Court of
the City of Haven, Kansas, the sum of Twenty Five Dollars ($25.00). Said costs
shall be assessed and be in addition to any fines, penalties or other orders of
the Haven Municipal Court.
SECTION THREE. The costs assessed shall be collected in the same manner as any other fines assessed by the Municipal Court.
SECTION FOUR. This ordinance shall be published once each week for two consecutive weeks in the official City newspaper.
SECTION FIVE. This is a charter ordinance and shall take effect sixty one (61) days after final publication, unless a sufficient petition for a referendum is filed, and a referendum held on the ordinance as provided in Article 12, Section 5, Subdivision (c) (3) of the Constitution of Kansas in which case the ordinance shall become effective if approved by the majority of the electors voting thereon.
PASSED BY THE GOVERNING BODY NOT LESS THAN TWO THIRDS OF THE MEMBERS ELECT VOTING IN FAVOR THEREOF THIS 6th DAY OF OCTOBER, 1997.
