A CHARTER ORDIANCE EXEMPTING THE CITY OF HAVEN, KANSAS FROM THE PROVISIONS OF K.S.A 1978 SUPP, 75-1117, 75-1120, 75-1121, 751122, K.S.A. 1979 SUPP, 75-1120 (a), SO AS TO NOT REQUIRE SAID CITY TO MAINTAIN FIXED ASSET RECORDS AND ACCOUNTING, OR BE REQUIRED TO HAVE ANNUAL AUDITS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF HAVEN, KANSAS:

Section 1. That the City of Haven, Kansas, a city of the third class, who and by virtue of the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt itself and does hereby exempt itself from the provisions of K.S.A. 1978 Supp. 75-1117, 75-1120, 75-1121, 75-1122 and K.S.A. 1979 Supp., 75-1120(a), and make said statutes inapplicable to said city insofar as said statutes require the City of Haven, Kansas maintain fixed asset records and accountings, or be required to have annual audits.

Section 2. This ordinance shall be published once each week for two (2) consecutive weeks in the Haven Journal, the official city paper.

Section 3. This is a charter ordinance and shall take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed and a referendum held on the ordinance as provided in Article 12 Section 5, Subdivision (c) (3) of the Constitution of Kansas, in which case the ordinance shall become effective if approved by a majority of the electors voting at an election held on the ordinance.

Passed by the governing body, not less than two-thirds of the members-elect voting in favor thereof, the 21st day of June, 1982.
