There is hereby incorporated by reference for the purpose of regulating traffic within the corporate limits of the City of Haven, Kansas, that certain standard traffic ordinance known as the “Standard Traffic Ordinance for Kansas Cities,” 49th Edition of 2022, prepared and published in book form by the League of Kansas Municipalities, save and except such articles, sections, parts or portions as are hereafter omitted, deleted, modified or changed, such incorporation being authorized by K.S.A. 12-3009 through 12-3012, inclusive, as amended. No fewer than three copies of said standard ordinance shall be marked or stamped “Official Copy as Adopted by Ordinance No. 705,” with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached a copy of this section, and filed with the city clerk to be open to inspection and available to the public at all reasonable hours. The Police Department, Municipal Judge and all administrative departments of the City charged with enforcement of the ordinance shall be supplied, at the cost of the City, such number of official copies of such Standard Traffic Ordinance similarly marked, as may be deemed expedient.

(a)   An ordinance traffic infraction is a violation of any section of this article that prescribes or requires the same behavior as that prescribed or required by a statutory provision that is classified as a traffic infraction in K.S.A. 8-2118.

(a)   All traffic violations which are included within this article, and which are not ordinance traffic infractions, as defined in subsection (a) of this section, shall be considered traffic offenses.

Changes to the Standard Traffic Ordinance is hereby changed to read as follows:

(a)   Section 2: Provisions of ordinance refer to vehicles upon streets and highway; exceptions. The provisions of this article relating to the operation of vehicles refer exclusively to the operation of vehicles upon streets and highways within this city except:

(1)   where a different place is specifically referred to in a given section.

(2)   The provisions of Section 29 and 31, inclusive, of this ordinance, and the provisions of Article 10 of Charter 8 of the Kansas Statutes Annotated, and any acts amendatory thereof, shall apply upon streets and highways and elsewhere throughout the city.

(3)   On land owned by the City where vehicular traffic is permitted, including to, but not limited to, public parks or recreational areas, means of ingress and egress to and around the City landfill and waste disposal areas.

(b)   Section 20(a) of the Standard Traffic Ordinance is hereby amended to read as follows:

(1)   The Chief of Police shall have authority to declare any street or part thereof a play street and to place appropriate signs of devices in the roadway indicating to protect the same.

(2)   The use of any street not so designated for recreational activities which involve pedestrians in the roadway, including but not limited to sport games, football, basketball, soccer, roller blading, roller skating or any other similar activity prohibited.

(c)   Section 114.1 in the Standard Traffic Ordinance is hereby deleted and Ordinance #635 regulating All-Terrain Vehicles remains in full force and effect.

(d)   Section 114.2 in the Standard Traffic Ordinance is hereby deleted and Ordinance #635 regulating Micro Utility Trucks remains in full force and effect.

(e)   Section 114.2 in the Standard Traffic Ordinance is hereby deleted and Ordinance #585 regulating Micro Utility Trucks remains in full force and effect.

(f)   Section 114.4 in the Standard Traffic Ordinance is hereby deleted and Ordinance #585 regulating Golf Carts remains in full force and effect.

(g)   Section 114.5 in the Standard Traffic Ordinance is hereby deleted and Ordinance #585 regulating Work-Site Utility Vehicles remains in full force and effect.
