The governing body, having determined upon the basis of
an engineering and traffic investigation, that the speed limit permitted under
state law and Section 33 of the Standard Traffic Ordinance is more or less than
is reasonable or safe under the conditions found to exist upon the following
streets and/or parts of the streets, it is hereby declared that the speed
limits upon such streets and/or parts of streets declared shall be effective
when appropriate signs giving notice thereof are erected upon such streets
and/or parts of streets:
(a) Buhler-Haven Road from First Street North to Fifth Street – 35 mph.
(b) Salina Avenue extended north from Fourth Street to Fifth Street – 10 mph.
(c) Industrial Drive from Haven Road to West Main – 40 mph.
(d) South Kansas
Avenue from Second Street to 96 Highway – 20 mph.

When signs are erected giving notice thereof no person
shall at any time school is in session park a vehicle on the east and west
sides of Emporia Street from Sedgwick Place to Sunset Lane.

(a) It shall be unlawful to park a truck with a registered gross weight of over 12,000 pounds, or a bus, truck tractor, road tractor or semi-trailer, regardless of weight, upon the streets in a residential area within the City of Haven, for a period longer than two (2) hour except as follows:
(1) For loading or unloading merchandise, furniture or other goods, a truck may be parked for so long as is reasonably necessary to remove the same.
(2) In case a vehicle is incapacitated or unable to move, a truck or trailer may be parked for so long as is reasonably necessary to remove the same, not to exceed 24 hours.
(b) It shall be unlawful for any motor vehicle used for the transportation of explosives, flammable liquids or liquified petroleum gases, which for such purpose is provided with a tank or tanks mounted on the frame or chassis of such vehicle or any vehicle, used for the transportation of explosives, flammable liquids or liquified petroleum gasses and for which such purposes provide with a tank or tanks mounted thereon, to be parked or permitted to stand in any area in the City of Haven, Kansas which has been designated a residential area, longer than is necessary to make a lawful delivery; provided that the standing of such vehicle made necessary by mechanical trouble, traffic conditions, accident on obedience to the direction of a policeman or traffic signals shall not be considered a violation. Fertilizer and ammonia trucks, hazardous gasses of any kind are included.
(c) Every person convicted of a violation of this section for which another penalty is not provided shall be punished for first conviction thereof by a fine of not more than one hundred dollars ($100.00) or by imprisonment for not more than ten (10) days; for a second such conviction within one year thereafter such person shall be punished by a fine of not more than two hundred dollars ($200.00) or by imprisonment for not more than twenty (20) days or by both such fine and imprisonment upon a third or subsequent conviction within one year after the first conviction such person shall be punished by a fine of not more than five hundred dollars ($500.00) or by imprisonment for not more than six (6) months or by both fine an imprisonment.

(a) There is hereby incorporated by reference
under the provisions of K.S.A. 12-3009 through 12-3012, and K.S.A. 12-3301 and
12-3302 for the purpose of regulating traffic upon highways and streets of the
City of Haven, Kansas that certain safety regulations handbook known as Federal
Motor Carrier Safety Regulations Handbook, February, 2012 Edition, Parts 383,
385, and 390-397, prepared and published in book form by J.J. Keller &
Associates, Inc., 3003 Breezewood Lane, P.O. Box 369, Neenah, WI 54957, save
and except such articles, sections, parts, or portions as are hereafter
omitted, deleted, modified, or changed. No less than three (3) copies of said
book shall be marked or stamped “Official Copy as Adopted by Ordinance No. 617,”
with all sections or portions thereof intended to be omitted or changed clearly
marked to show any such omission or change and to which shall be attached a
copy of the Ordinance codified herein and filed with the City Clerk to be open
to inspection and available to the public at all reasonable hours. The Police
Department, Municipal Judge, and all administrative departments of the City
charged with the enforcement of these regulations shall be supplied, at the
cost of the City, such number of official copies of said book as may be deemed
expedient.
(b) It shall be unlawful for any person to violate the provisions of the Federal Motor Carrier Safety Regulations Handbook, Parts 383, 385, and 390-397.
(c) The judge of the Municipal Court shall, in the manner prescribed by K.S.A. 12-4305 or any amendments thereto, establish a schedule of fines for violations of any section of the Federal Motor Carrier Safety Regulations Handbook, Parts 383, 385, and 390-397 classified as an ordinance traffic infraction by K.S.A. 8-2118 and amendments thereto. Such fines shall be imposed upon a voluntary entry of appearance and upon a plea of guilty or no contest to a complaint alleging such violation and payment of the fine and any court costs.
(d) A person who has been convicted of a traffic infraction may be sentenced to pay a fine which shall be fixed by the court, not exceeding $500.
(e) Every person who violates any provision of the Federal Motor Carrier Safety Regulations Handbook, Parts 383, 385, and 390-397 for which another penalty is not provided by this section or by the schedule of fines established by the judge of the municipal court shall be punished for the first conviction thereof by a fine of not more than $500 or by imprisonment for not more than one month or by both such fine and imprisonment; for a second such conviction within one year thereafter such person shall be punished by a fine of not more than $1,000 or by imprisonment for not more than six months or by both such fine and imprisonment; upon a third or subsequent conviction within one year after the first conviction such person shall be punished by a fine of not more than $2,500 or by imprisonment for not more than one year or by both such fine and imprisonment.

(a) Parking prohibition generally.
(1) It shall be unlawful for any person, firm, or corporation to park any utility truck, travel trailer, camper, recreational vehicle, or any bus, trailer, truck tractor, semi-truck tractor, semi-trailer, or the trailer components thereof, regardless of weight; upon any street or alley in the City of Haven, Kansas, except as provided in section (b) hereof.
(2) Streets and alleys mean the entire width between the boundary lines of every way which is publicly maintained down any part thereof which is open to the public for purposes of vehicular traffic.
(b) Exceptions.
(1) Any utility truck, bus, trailer, truck tractor, semi-trailer, travel trailer, camper, recreational vehicle, or the trailer component thereof, may be parked temporarily on any street or alley in the City of Haven, Kansas, for so long as may be necessary, not to exceed 72 hours, to make deliveries of cargo therefrom to stores, residences, or business establishments in said City, or to load cargo into such trailers for said premises for delivery elsewhere.
(2) In case such vehicle is incapacitated or unable to move, it may be so parked for only as long as is reasonably necessary, and not to exceed seventy-two (72) hours.
(3) A truck tractor or road tractor may be parked, if detached from its trailer or load, in a driveway on private property, with the consent of the owner of said property, if the motor be immediately turned off.
(4) Any trash dumpster temporarily placed upon any City street or alley in accordance with any program approved by the City pursuant to Section 15-404(f) of the City Code not to exceed seven (7) days.
(c) General Penalties. Every person, firm or corporation convicted of a violation of any of the provisions of this section shall, for the first conviction thereof, be punished by a fine of not more than One Hundred Dollars ($100.00); and for a subsequent conviction such person shall be punished by a fine of not more than Five Hundred Dollars ($500.00), PROVIDED, HOWEVER, that each day of a violation constitutes a new separate offense.

(a) J Turns Unlawful. It shall be unlawful for the driver of any vehicle to make a J Turn on Kansas Avenue between Highway 96 and one-half block north of Main on Kansas Avenue, an area commonly known as the central business district, except at the intersection of two or more public streets, and private roads or driveways for the purpose of entering onto private property.
(b) J Turns Defined. A J Turn for the purpose of this section shall be defined as a turning movement to the left across the flow, or potential flow, of oncoming traffic.
(c) U Turns. It shall be lawful to make a U Turn at:
(1) the intersection of Kansas Avenue and Second Street.
(2) the intersection of Kansas Avenue and Main Street.
(3) the intersection of Kansas Avenue and First Street.
(d) Penalty. Any person violating any provision of this section shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished at the discretion of the court.
