AN ORDINANCE AMENDING SECTION TWO OF CHARTER ORDINANCE NO. 3 RELATING TO THE ASSESSMENT OF COURT COSTS IN THE HAVEN MUNICIPAL COURT AND REPEALING ORDINANCE NO. 555.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF HAVEN, KANSAS:

SECTION ONE. That Section Two of Charter Ordinance No. 3 passed and approved by the Governing Body on October 6, 1997, is hereby amended to read:

SECTION TWO:

(a)   There shall be assessed as court costs in all cases filed in the Municipal Court of the City of Haven, Kansas, the sum of Sixty Dollars ($60.00). Said costs shall be assessed and be in addition to any fines, penalties or other orders of the Haven Municipal Court.

(b)   The Municipal Judge in addition to assessing court costs may assess against any defendant ordered to serve a sentence in the Reno County Detention Center any fees charged to the City of Haven by Reno County for housing or keeping said defendant during his or her period of incarceration.

SECTION TWO. If any provision or part thereof is declared to be invalid by any court of competent jurisdiction the remaining portions remain in full force and effect.

SECTION THREE. That all other provisions of Charter Ordinance No. 3 shall remain in full force and effect.

SECTION FOUR. That this amendment to Charter Ordinance  No. 3 shall take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed and a referendum held on the ordinance as provided in Article 12, Section 5, Subdivision C(3) of the Constitution of Kansas in which case the ordinance shall become effective if approved by the majority of the electors voting thereon.

SECTION FIVE. Ordinance No. 555 passed and approved by the governing body on September 19, 2005, is hereby repealed in its entirety.
