The following words and terms shall have the meanings ascribed to them in this section:

(a)   Parade: any parade, procession, motorcade, march, pageant, review, ceremony, or exhibition consisting of people, animals, vehicles, equipment, conveyances or any combination thereof, which is conducted in, on, upon or along any portion of any public street, sidewalk, or other property owned and controlled by the City.

It shall be unlawful for any person to engage in, aid, form, start, or conduct a parade without having first obtained a permit from the City.

(a)   Exceptions. This section shall not apply to the following: funeral processions; a governmental agency acting within the scope of its function.

(b)   Application.

(1)   Applications shall be upon a form furnished by the City Clerk. Each application shall contain full and detailed information including, but not limited to, the following:

(A)  A description of the proposed event;

(B)  The street or other public property and the specific area(s) thereof which will be utilized in connection with the proposed parade;

(C)  The manner in which the property will be used;

(D)  The date and times that the public property is to be utilized for the parade.

(E)   The name, address, and telephone number of the person or persons to be contacted regarding the application; and

(F)   Such other information necessary in order to properly provide for traffic control, street and property maintenance, administrative arrangements, police and fire protection and the protection of public health, safety, and welfare.

(2)   Application for parade permit must be filed with the City Clerk ten (10) working days prior to the date of the event. The City Clerk may waive the minimum ten (10) day filing period if it is determined that the waiver will not present a hazard to public safety. There is no application fee.

(c)   Non-Discrimination. The City Clerk shall uniformly consider each application pursuant to the standards listed in this Section and shall not discriminate in granting or denying an application based upon any viewpoint, political, racial or religious grounds.

(d)   Fees and service charges.

(1)   An applicant shall pay the City for all City departmental service charges incurred in connection with the proposed parade. If City property is destroyed or damaged by reason of the applicant’s event, the applicant shall reimburse the City for the actual replacement or repair cost of the destroyed or damaged property.

(2)   City departments affected by the applicant’s request shall submit final invoices that will comprise the service charges to the applicant, no later than ten (10) working days after the expiration date of the permit.

(3)   At least three (3) days prior to the effective date of any permit, the applicant shall pay to the City a cash deposit in an amount sufficient to cover the total City service charges as estimated by the City Clerk.  In the event the deposit does not cover the actual City costs, the applicant shall be billed for the difference, due within ten (10) days of billing.

(4)   If the parade permit is revoked pursuant to Section Two (f), the deposit, if any, shall be returned to the permittee minus those charges which City departments incurred.

(e)   Permit Issuance Standards. The City Clerk shall cause a parade permit to be issued under this article no later than five (5) days prior to the event, if it is determined that the following standards have been met:

(1)   The proposed parade is in compliance with all other City Ordinances.

(2)   The preparation for, or the conduct of, the proposed parade will not unduly impede, obstruct, or interfere with traffic or the public use of the street or other public property.

(3)   The preparation for or the conduct of the proposed parade will not unduly impede, obstruct, impair, or interfere with the operation of emergency vehicles or equipment or adversely affect the City’s ability to perform municipal functions in the permit area.

(4)   The proposed parade does not present a substantial safety or traffic hazard.

(5)   The parade is scheduled to move from its point of origin to its point of termination expeditiously and without unreasonable delays enroute.

(6)   The parade is not to be held for the sole purpose of advertising a product, good, or event and is not designed purely for private profit.

(7)   The parade will not exceed two hours in duration.

(8)   The parade will not interfere with another parade or public event already scheduled.

(9)   Adequate sanitation and other facilities will be made available.

(f)   Revocation. The City Clerk may deny any application for a permit or revoke a permit if he or she determines that the applicant or permit holder has made any misleading statement in the application; or has not complied with the requirements of this article.  In the event of an emergency, inclement weather, or other condition that imperils persons or property in the parade route area, the City Clerk may revoke or suspend the permit to a later date and time.

(g)   Appeal. Decisions of the City Clerk may be appealed to the governing body by filing a notice of appeal prior to the proposed date with the Assistant City Clerk. The appeal shall then be placed on the agenda for the next regularly scheduled meeting of the Governing Body.

The following prohibitions shall apply to all parades:

(a)   It shall be unlawful for any person to conduct a parade without a permit from the City.

(b)   It shall be unlawful for any person to participate in a parade for which the person knows a permit has not been issued.

(c)   It shall be unlawful for any person in charge of, or responsible for the conduct of, a duly licensed parade to knowingly fail to comply with any condition of the permit.

(d)   It shall be unlawful for any person to engage in any parade activity that would constitute a substantial hazard to the public safety or that would materially interfere with or endanger the public peace or rights of residents to the quiet and peaceful enjoyment of their property.

(a)   It shall be unlawful for any person to knowingly join in or participate in any permitted parade without the consent of the person in charge for the conduct of any parade.

(b)   It shall be unlawful for any person to hamper, obstruct, impede or interfere with any parade or any person, vehicle, or animal participating or used in a parade.

(c)   The Police Chief shall have the authority to prohibit or restrict the parking of vehicles along a street constituting a part of a parade route.  Signs may be posted to temporarily restrict parking, and it shall be unlawful for any person to park or leave unattended any vehicle in violation thereof.

(d)   It shall be unlawful, unless directed by a police officer, for a driver of a vehicle to drive between the vehicles, persons, or animals comprising a parade when the parade is in motion and is conspicuously designated as a parade.

Violation of this article shall, upon conviction, be punished by a fine not to exceed one thousand dollars ($1000.00) or imprisonment of not more than one hundred eighty (180) days, or both fine and imprisonment.
